1. Introduction
This Privacy Policy describes how Calivo collects, uses, and shares your personal information when you visit our website or use our online coaching services. By using our services, you agree to the collection and use of information in accordance with this policy.

2. Information We Collect
We collect information that you provide directly to us and through our third-party service providers.

Personal Identification Information: Name, email address, phone number, and mailing address.

Health and Biometric Data: Because our services are personalized, we collect sensitive information including, but not limited to: age, weight, height, body fat percentage, medical history, physical limitations, activity levels, and progress photos.

Nutrition and Lifestyle Data: Information regarding your dietary habits, calorie/macronutrient adherence, and lifestyle preferences.

Payment and Billing Information: We collect payment details necessary to process your coaching fees for the 12-week program. This is handled securely by our payment processor, Stripe. We do not store your full credit card details on our servers.

3. How We Use Your Information
We use the collected data for the following purposes:

Service Delivery: To deliver accountability coaching and create and manage your personalized nutrition and workout plans.

Progress Tracking: To monitor your biometrics and adherence to ensure you are meeting your fitness goals.

Communication: To provide coaching feedback, check-ins, and support via Kahunas, email, and video meetings.

Payment Processing: To process transactions and manage billing through Stripe.

Improvement: To analyze trends and improve our coaching methodologies.

4. Data Sharing and Third-Party Processors
We do not sell your personal data. However, we use professional third-party tools to facilitate our services:

Kahunas: Our primary coaching platform. Kahunas stores and processes your biometrics, workout logs, and nutrition data to allow for real-time coaching and tracking.

Stripe: Our payment processor. Stripe handles all billing information securely. You can find their privacy policy at https://stripe.com/privacy.

Communication Tools: We may use email providers and video conferencing software (e.g., Zoom or Google Meet) for our scheduled check-ins.

5. Data Security
We implement industry-standard security measures to protect your personal and health data. However, please note that no method of transmission over the internet or electronic storage is 100% secure. We encourage you to use strong passwords for your Kahunas account.

6. Data Retention
We retain your personal and health data only for as long as is necessary for the purposes set out in this Privacy Policy, or as required by law (e.g., for tax or accounting purposes).

7. Your Rights
Depending on your location, you may have the following rights:

Access: The right to request copies of your personal data.

Correction: The right to request that we correct any information you believe is inaccurate.

Erasure: The right to request that we erase your personal data, under certain conditions.

Withdraw Consent: Since we process sensitive health data, you may withdraw your consent for us to process this data at any time, though this may result in the termination of coaching services.

Terms of Service

Effective Date: April 21, 2026

1. Acceptance of Terms
By purchasing any coaching package or using the services provided by Calivo, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the services.

2. Scope of Coaching Services
The Coach provides online accountability coaching for fitness and habits across a 12-week graduation arc, which includes weekly coaching calls throughout the program, coach-initiated daily check-ins during the early phase (approximately weeks 1 to 4) that transition to shared and then Client-led check-ins with reactive Coach support in the later phases (approximately weeks 5 to 8 and 9 to 12 respectively), habit and mindset coaching, workout programming, and nutritional guidance delivered via the Kahunas app, email, and voice or text messages. The graduated check-in cadence is a core feature of the program and is designed to build Client autonomy by graduation.

What is NOT included:

Medical diagnosis or treatment.

Physical therapy or rehabilitation services.

Psychological counseling or therapy.

Prescription of any medication or supplements.

3. Health and Medical Disclaimer
NO MEDICAL ADVICE: The information provided through our coaching is for educational and informational purposes only. The Coach is not a doctor, registered dietitian, or licensed medical professional.

Consult a Physician: You should consult with a healthcare professional before starting any diet or exercise program, especially if you have a history of high blood pressure, heart disease, or any other physical condition.

Assumption of Risk: You acknowledge that physical exercise involves an inherent risk of injury. By participating in this program, you voluntarily assume all risks associated with the program.

4. Payment and Billing
Program Term: The Calivo coaching program is a fixed 12-week engagement. Fees for the full 12-week term are either paid in full at enrollment or billed in monthly installments across the three months of the program, depending on the rate purchased.

Payment Processing: All payments are processed securely through Stripe.

Finality of Sale: All payments are final. Fees paid or owed for the 12-week program are non-refundable for any reason, including but not limited to: lack of results, change of mind, or failure to utilize the coaching services. Where fees are paid in installments, all installments for the 12-week term remain payable in full regardless of continued participation.

No Auto-Renewal: Billing ends automatically at the conclusion of the 12-week program. There is no recurring subscription beyond the 12-week term, and no action is required on your part to end billing.

5. End of Program and Cancellation
End of Program: No cancellation action is required at the end of the 12-week term. Billing ends automatically, and your access to the coaching platform concludes at that time.

Continuation After Graduation: Any coaching arrangement beyond the initial 12-week program is a separate agreement, discussed one-on-one and subject to its own terms. It is not automatic and will not begin without your explicit agreement.

Stopping Coaching Mid-Program: You may stop participating in the coaching at any time by contacting the Coach. Stopping participation does not entitle you to a refund of fees already paid and does not release you from any remaining installment payments scheduled for the 12-week term. See Finality of Sale above.

Pauses for Exceptional Circumstances: If a significant life event such as illness, family emergency, or extended travel requires you to pause the program, contact the Coach directly. Pauses are handled case-by-case at the Coach's discretion and are not guaranteed.

6. Client Responsibilities
To achieve results, the Client agrees to:

Provide honest and accurate biometric and health data.

Communicate any pain, discomfort, or medical changes immediately.

Adhere to the check-in schedule to ensure the Coach can make necessary adjustments.

7. Intellectual Property
All workout plans, nutritional guidelines, and educational materials provided to you are the intellectual property of Calivo. You are granted a limited, non-transferable license for personal use only. You may not share, sell, or redistribute these plans to third parties.

8. Limitation of Liability
To the maximum extent permitted by law, Calivo and its owner shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the coaching services, or for the cost of procurement of substitute services. This includes, but is not limited to, physical injury, illness, or death.

9. Termination of Services
The Coach reserves the right to terminate the coaching relationship at any time if the Client is found to be in violation of these terms, is disrespectful to the Coach, or if the Coach determines the Client's health needs exceed the scope of online coaching.

10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.
